DELIBERATIONS OF THE MEETING HELD ON 23RD SEPTEMBER 2009 AT 17:30 HOURS

Item I Chief Pleas

The following person, whose name is included on the Register of Voters and who had given due notice, addressed the States on matters of public interest: -

Mr Raymound Gaudion spoke on the effect of the building of the New Connaught Care Home on local building companies and unemployment.

Item II New Connaught Care Home

The States resolved after consideration of the above report from the Chairman of the Policy and Finance Committee, and subject to approval by the Guernsey States of Deliberation, to :-
1. Approve the building of the New Connaught Care Home as detailed in the above report.

2. Accept the tender from J. W. Rihoy & Son Ltd in the sum of £2,110,719.57.

3. Approve the additional cost of £389,280 to cover professional fees and expenses, project supervision, supply and transportation of prefabricated bathroom pods and other costs associated with the project.

4. Vote the sum of £2,500,000 to cover the overall cost of the project.

5. On completion of the above project sell the existing Royal Connaught Residential Home.
(Proposed by Mr Willmott and seconded by Mr Williams.)
(Approved by a majority.  All in favour except Messrs Allen and Beaman who voted against.  Mr Tugby abstained.)

Item III Sale of States Land

The States resolved that:-
1. The area of land at Crabby, listed as AY 100 (part), parcel no 252 (part), may be disposed of by the General Services Committee by way of freehold sale, by sealed tender, at a price to be approved by the Policy and Finance Committee.

(Approved by a majority.  All in favour except Messrs Allen, Kelly and Beaman who voted against.)

2. The area of land at Hauteville, listed as AY 80, may be disposed of by the General Services Committee by way of freehold sale, by sealed tender, at a price to be approved by the Policy and Finance Committee.

(Approved by a majority.  All in favour except Mr Beaman who voted against, Mr Allen abstained.)

3. There will be no obligation on the part of the States to sell either of the above areas of land if the offers received are considered to be too low.
(Approved unanimously.)

Item IV The Companies (Alderney) Law 1994 - Fees Ordinance 2009

The States resolved to approve of “The Companies (Alderney) Law (Fees) Ordinance 2009”.

(Proposed by Mr Willmott and seconded by Mr Williams.)
(Approved unanimously.)

Item V Alderney Commission for Renewable Energy – Appointment of Chairman

The States resolved that Dr John Antill be appointed as executive Chairman of the Alderney Renewable Energy Commission with effect from 23rd September 2009 for the remainder of his term as Commissioner which expires on 10th November 2013.

(Proposed by Mr Willmott and seconded by Mr Tugby.)
(Approved by a majority.  All in favour except Mr Beaman who voted against.)

Item VI The Renewable Energy (Specified Committee) (Alderney) Ordinance, 2009

The States resolved to approve “The Renewable Energy (Specified Committee) (Alderney) Ordinance, 2009” as amended.

(Proposed by Mr Willmott and seconded by Mr Williams.)
(Approved by unanimously.)

Item VII The Housing (Exemptions) (No.4) (Alderney) Ordinance, 2009

The Sates resolved to approve “The Housing (Exemptions) (No.4) (Alderney) Ordinance, 2009”.    

(Proposed by Mrs Bennett and seconded by Mr Sargent.)
(Approved unanimously.)

Item VIII The Statements Obtained Under Compulsion (Restriction of Use) (Bailiwick of Guernsey) Law, 2009

The States resolved to approve “The Statements Obtained Under Compulsion (Restriction of Use) (Bailiwick of Guernsey) Law, 2009”.
(Proposed by Mr Allen and seconded by Mr Kelly.)
(Approved unanimously.)

Item IX The General Sales Tax (Enabling Provisions) (Guernsey and Alderney) Law, 2009

The following amendment was proposed by Mr Willmott and Seconded by Mr Williams:
“That the item be withdrawn for one month to allow for consultation with the Law Officers, Treasury and Resources and Policy and Finance Committee.”
The States resolved to withdraw this item.

(Proposed by Mr Willmott and seconded by Mr Williams.)
(Approved unanimously.)

Item X Questions and Reports

A question for verbal reply regarding confidential annexure was asked by Mr Allen of the Chairman of the Policy and Finance Committee.

Mrs Bennett reported that the Building and Development Control Committee were proposing a number of revisions to the ‘C’ Permit process with an aim to avoid properties being built and then sold on to second home owners, to encourage more applications from local residents to build and to stimulate the local building trade.

Developments in Social Care - Mrs Bennett was pleased to announce that the States of Alderney had agreed to allocate £20k in the budget for social care and that a strategy document for social care would be present at the next board meeting in Guernsey.   Additionally Guernsey Mental Health Services intended to reinstate a part time social worker post and provide regular visits by a psycho geriatric community nurse. 

Mrs Bennett advised that a meeting had been held with Guernsey Citizens Advice Bureaux to improve the service for Alderney residents.  Further information regarding this service would be publicised soon.

Mrs Bennett reported that following recent changes to children’s legislation the Convenor and Lay Members of the Children’s Panel had visited Alderney in order to acquaint themselves with the services for children.  During the two day visit they met with the Police, the Youth Club, the Toddler Playgroup and The Salvation Army.   It was noted that, at the request of the Scrutiny Committee in Guernsey, a report would be submitted regarding Youth Services and the reduction of vandalism in Alderney.

The President gave his thanks and appreciation, on behalf of everyone, to those who had organised a splendid Alderney Week and the visit of the 30th Signal Regiment.

The President reported that he had received a petition against the proposed smoking legislation, which would be presented at the next meeting of the Policy and Finance Committee.
