COMMERCIAL UNION LIFE ASSURANCE COMPANY LIMITED ("CULAC"), CGNU LIFE ASSURANCE LIMITED ("CGNU Life") and AVIVA LIFE & PENSIONS UK LIMITED ("AVLAP") (formerly known as NORWICH UNION LIFE & PENSIONS LIMITED)
                             
NOTICE is hereby given pursuant to Section 45(3)(a) of the Insurance Business (Bailiwick of Guernsey) Law, 2002 that:

1.   CULAC, CGNU Life and AVLAP (the "Applicants") intend to apply to the Royal Court of Guernsey for the sanction pursuant to Section 44 of the Insurance Business (Bailiwick of Guernsey) Law, 2002 by the Royal Court of Guernsey of a scheme (the "Scheme") under which certain long term insurance business carried on in Guernsey by CULAC and CGNU Life is to be transferred to AVLAP.

2.   The Applicants have made copies of:
  • (a) the proposed application; and
  • (b) the report of an independent actuary (the "Report")
available for inspection (or for collection free of charge) at all reasonable times at the offices of Mourant du Feu & Jeune at the address given below up to and including the date of the court hearing. In addition, copies of the Report and a statement setting out the terms of the Scheme can be obtained free of charge by contacting Aviva, Fund Transfer Team, PO Box 3312, Surrey Street, Norwich, NR1 3FE United Kingdom in writing or by telephone on 0800 051 1300 (+44 1603 208808 if calling from overseas) between Monday and Friday from 9am to 5pm from the date of publication of this notice until the date on which the Royal Court of Guernsey sanctions the Scheme. These documents can also be viewed on the website at www.aviva.co.uk/fundtransfer.

3. The application to sanction the Scheme is due to be heard by the Royal Court of Guernsey at The Royal Court House, St Peter Port, Guernsey on 29 September 2009 at 10.15am.

4. Any person (including any employee of any of the Applicants) who alleges that he would be adversely affected by the carrying out of the Scheme is entitled to be heard by the Royal Court of Guernsey. If you intend to appear at the hearing before the Royal Court of Guernsey, you are requested to give two clear days’ notice of your intention to do so to Mourant du Feu & Jeune, at the address given below.
