NOTICE OF APPROVAL
Alderney Offical Gazette Volume 15 Number 2 (States ID: 0150002)Date: 11th January, 2008
Under section 13 of the Health and Safety at Work (Alderney) Ordinance, 2003, the Policy and Finance Committee has, for the purposes of providing practical guidance with respect to the requirements of that Ordinance, approved the code of practice entitled "Commercial diving projects inland/offshore."
This code of practice was issued by the United Kingdom Health and Safety Commission and approved by them on 10th December, 1997.
The Committee's approval of the code of practice is with immediate effect but the date by which all divers at work must obtain an approved diving qualification for the work they intend to do (paragraph 134) is 1st December 2009.
Explanatory Note: The references in the code of practice to United Kingdom legislation should be taken as references to the Health and Safety at Work (Alderney) Ordinance, 2003, the general duties being the same in each case. The code of practice supplements the requirements of the Ordinance and gives practical advice on how to comply with the law. If you follow the advice you will be doing enough to comply with the law in respect of those specific matters on which the code gives advice.
Failure to observe the code is not an offence in itself but can be taken as proving that the defendant has failed to comply with the ordinance, unless he can demonstrate that he complied with the Ordinance in some alternative and equally effective way.
A copy of the code of practice may be inspected at the office of the Chief Executive.
