NOTICE OF APPLICATION FOR EGAMBLING LICENCES AND ASSOCIATE CERTIFICATES

An application for a Category 1 eGambling licence, dated 9th August 2011 has been made to the Alderney Gambling Control Commission (“the Commission”) under the Alderney eGambling Ordinance, 2009 and the Alderney eGambling Regulations, 2009 by:-

Any person wishing to raise any objection to this application so that the objection shall be considered by the Commission in accordance with regulation 23, 30 or 74 of the Alderney eGambling Regulations, 2009 should, within 14 days of the date of publication of this notice, deliver or send to the offices of the Commission a written statement of the objection and the grounds on which it has been raised.

(together the “Parties”)
TAKE NOTICE that the Parties intend to apply to the Royal Court of Guernsey (the “Court”) on 20 September 2011 at 10:15am (the “Application”) for an order under Section 44 of the Insurance Law sanctioning a scheme (the “Scheme”) providing for:
  • (i) the transfer to AWL of part of the insurance business carried on by WLUK (namely certain individual business and corporate trustee investment plans); and

  • (ii) the transfer to WLUK of part of the insurance business carried on by AWL (namely, a book of life and pensions business)
and making supplementary provision in connection with the Scheme pursuant to Section 48 of the Insurance Law.

Copies of the Application and a report on the terms of the Scheme prepared by an independent expert pursuant to Section 45(2)(a) of the Insurance Law (the “Scheme Report”) are available for inspection (and in the case of the Scheme Report for collection) during office hours at the Parties’ Advocates at the address below.  In addition, the Scheme Report, a Scheme guide containing a statement setting out the terms of the transfer and a summary of the Scheme Report and the Scheme document may be obtained free of charge by contacting WLUK or AWL (as appropriate) using the relevant telephone number or address set out below from the date of publication of this Notice until the date on which the Application will be heard before the Court.  These documents and other related documents (including actuarial reports and sample copies of the communications to policyholders) are available at www.winterthur-life.co.uk.

The Application is due to be heard at the Royal Court of Guernsey, St Peter Port, Guernsey on Tuesday 20 September 2011 at 10:15am. Any person who thinks that he or she would be negatively affected by the carrying out of the Scheme may attend the hearing and express their views, either in person or by Counsel.  Anyone intending to do so is asked to inform WLUK or AWL (as appropriate) at the address provided above as soon as possible and preferably before 9 September 2011 setting out their grounds for objection and to give not less than seven clear days’ prior notice in writing of such intention and the reasons therefore, to the Parties’ Advocates at the address set out below. This will enable WLUK or AWL (as appropriate) to provide notification of any changes to the hearing and, where possible, to address any concerns raised in advance of the hearing.

Any person who objects to the Scheme but does not intend to attend the hearing may make representations about the Scheme by giving written notice of such representations to WLUK or AWL (as appropriate) in writing as soon as possible and preferably before 9 September 2011.

AWL and WLUK (as appropriate) will inform the Guernsey Financial Services Commission of any objections raised in advance of the hearing, regardless of whether the person making the objection intends to attend the hearing.
