Hamilton Life Assurance Company Limited ("Hamilton Life") Aviva Life & Pensions UK Limited ("AVLAP") (previously known as Norwich Union Life & Pensions Limited)
NOTICE is hereby given pursuant to Section 45(3)(a) of the Insurance Business (Bailiwick of Guernsey) Law, 2002 that:
1. Hamilton Life and AVLAP intend to apply to the Royal Court of Guernsey for the sanction pursuant to Section 44 of the Insurance Business (Bailiwick of Guernsey) Law, 2002 by the Royal Court of Guernsey of a scheme (the "Scheme") under which certain long term insurance business in respect of Guernsey-resident policyholders is to be transferred from Hamilton Life to AVLAP.
2. Hamilton Life and AVLAP have made copies of:available for inspection (or for collection free of charge) at all reasonable times at the offices of Mourant du Feu & Jeune at the address given below up to and including the date of the court hearing. In addition, copies of the Report may be obtained free of charge from Hamilton Life, from its website at www.hamiltontransfer.com, by writing to the Hamilton Transfer Support Team, PO Box 349, Surrey Street, Norwich NR1 3FX or by telephone on 0800 158 3468 (or +44 1603 603894 if calling from outside of the United Kingdom) between 9:00am and 6:00pm, Monday to Friday, and between 9:00am and 5:30pm on Saturdays, from the date of publication of this notice until the date on which the Court is asked to sanction the Scheme.
- (a) the proposed application; and
- (b) the report of an independent actuary (the "Report")
3. The application to sanction the Scheme is due to be heard by the Royal Court of Guernsey at The Royal Court House, St Peter Port, Guernsey on 22 December 2009 at 10.15am.
4. Any person (including any employee of any of Hamilton Life or AVLAP) who alleges that he would be adversely affected by the carrying out of the Scheme is entitled to be heard by the Royal Court of Guernsey. If you intend to appear at the hearing before the Royal Court of Guernsey, you are requested to give two clear days notice of your intention to do so to Mourant du Feu & Jeune, at the address given below.
